He was issue of his father James' second marriage to Elizabeth. James original will was contested by James William M. Tate and his mother (Elizabeth) won the estate for herself and her children. He is buried in the same cemetery as his father. James William M's first wife is also buried there but there is no marker. In his will he stated his mother died and was buried in West TN.

Surveyed April 22, 1837 for James Tate, 5000 acres by entry dated September 22, 1836, No. 4286 on the waters of Collins River and Little Sequatchie, SE corner of said Sitz's 200 acre tract he now lives on, east side of Clifty Creek, cross Sequatchie Creek, including and platting out 343 acres of prior claims belonging to Henry Spong and (blank) Wilson. WILL OF J. W. M. TATE April 19, 1873
I bequeath my soul to God who gave it. Secondly, I direct that my debts and funeral expenses be paid. Thirdly, I will that a tombstone be bought in Nashville worth $100.00 and be put up at my father's grave, and one worth $50.00 at my mother's grave who died and was buried in West Tennessee. I also direct that a tombstone worth $50.00 be put up at the grave of my deceased wife, Mary, and worth $100.00 be put at my grave. Fourthly, I will that a good foundation of dressed stone be put around the graves of my father, my deceased wife, myself and little boy, and that an iron fence be put around said graves. Fifthly, I direct that my property, both real and personal, be sold. Sixthly, I will that my executor, after winding up my estate, pay over to L. D. Mercer, who I appoint to act as Trustee for my wife, Lyncha and two children, J. K. P. Tate and Susan E. Bain, formerly Susan E. Tate, all the money in his hands belonging to my estate. Upon the death of either or both of these, sufficient amount be used to give them a decent burial and tombstones for their graves worth $100.00, and the balance of any to be divided between the heirs of their bodies as they become of age. In the event that my said children having no heirs of their body, then his or her interest to be divided between the heirs of the other chid. Lastly, I appoint J. Furm Morford, executor of this will. Witnessed by W. B. Smartt and W. L. Swann. Recorded June 2, 1873.
